Stevenson, Wong & Co. Gave a Presentation to Hong Kong Securities & Futures Employees Union

On 22 November 2018, Stevenson, Wong & Co. Compliance Director Mr. Roy Chan was invited to give a presentation to the members of Hong Kong Securities & Futures Employees Union. He delivered a speech on the topic of “Investigation Power under the SFO” and attracted nearly 260 attendees.

Roy is an experienced financial investigator. He specializes in the investigation of complex commercial crimes including banking fraud, money laundering, market manipulation, insider dealing and securities broker’s misconduct. Before joining the firm, he was a Senior Manager at the Enforcement Department of the Securities and Futures Commission after eight years of service with the Commercial Crime Bureau of the Royal Hong Kong Police Force. He investigated and suppressed illegal or improper practices in securities and futures trading, leveraged foreign exchange trading and collective investment schemes in Hong Kong, and enforced disclosure of interests of substantial shareholders, directors and chief executives of listed companies. He has extensive experience in conducting cross-border investigations and engaging in criminal trials and proceedings before the Market Misconduct Tribunal.

Stevenson, Wong & Co. Attended STEP Asia Conference 2018

On 20-21 November 2018, Stevenson, Wong & Co. Partner Ms. Wendy Lam and Consultant Ms. Shirley Sin attended STEP Asia Conference 2018 held at Grand Hyatt Hong Kong. The two-day conference gathered over 50 experts from different jurisdictions to share their insight and experience in a wide spectrum of global issues and specialist topics.

The two-day conference covered various issues – “PRC succession issues”, “Blockchain 101 for the private wealth industry”, “Protecting today’s wealthy families”, “Buying and selling trust and corporate service providers”, “Innovative trust provisions being considered in more conservative courts”, “Family retreats – the way forward?” and “US reform – impact on the private wealth industry”.

The keynote speech on day one was titled “Why these things matter”. This address examined the philosophical foundations of legal privileges, protections and conventions. The conference also included an analysis of certain fundamental privileges and how the OECD’s initiatives are a potential threat. The break-out sessions provided an insight into taxation and other planning concerns.

Acting Secretary for Financial Services and the Treasury, Mr. Joseph Chan gave a keynote speech on “The state of private wealth management in Hong Kong”. He shared his vision for the continued development of private wealth management in Hong Kong. Day two break-outs considered a range of topics on tax and trusts and also, looked at how issues relating to an ageing population may affect the industry.

Stevenson, Wong & Co. Partner Ms. Catherine Por Attended Evaluative Mediation Training

The head of our Private Client Department, Ms. Catherine Por, attended an Evaluative Mediation Training Course organized by The Hong Kong Academy of Law between 16, 17 and 18 November 2018. The Course was presented by Professor John Wade, the Emeritus Professor of Law of Bond University, Australia.

Professor Wade is a well-respected mediator, trainer and academic in the field of mediation. Although Professor Wade has previously taught many mediation courses in Hong Kong, this was the first course on Evaluative Mediation. It was recognized by the participants that even the definition of “Evaluative Mediation” was a challenging topic. An accepted description is that it is a process whereby parties to a dispute attempt to negotiate an acceptable solution with the assistance, ideas and advice from an Evaluative Mediator. This is seen to be distinguishable from Facilitative Mediation in that the mediator, in an evaluative mediation, actually provides advice, opinions and recommendations as to the outcome of the dispute.

There is clearly an interest in Hong Kong in the broadening of mediation as an alternative process in dispute resolution. Catherine Por was very pleased to have participated in this potential new initiative for Hong Kong.

In 2009, the Department of Justice launched a campaign called “Mediate First Pledge” to promote the use of mediation to resolve disputes in Hong Kong. Stevenson, Wong & Co. signed the Mediate First Pledge and is committed to first exploring the use of mediation in resolving disputes. In May of this year, the Department of Justice organized Mediation Week 2018. The theme was “Mediate First-Exploring New Horizons”. It sought to look ahead at future developments including online dispute resolution and the use of mediation in resolving international commercial disputes.
